This is a very good point made by Ricky (above) – Many times “ownership” is grounds for significant problems later on, as much work may be a mixture of opensource or proprietary or Creative Commons licensing schemes. Worse, you may have code supplied to you subject to the Affero license
(I like to call it, GPL on CRACK)

Basically it means that anybody even visiting your website has the ability to demand you give them a code of the source code and any modifications you made to it, over the web (which means they could kill you with bandwidth charges alone!)

I do believe you need a 16th item. Ownership of the web elements being developed. Any contract should clearly specify ownership of the software and whether any copies can be retained by the developer.

Great ideas here. One other thing I like to specify is how many rounds of “revisions” may or may not be included. Once the pages are developed with content in place, there always seem to be changes to text and often photo selections. I like to estimate time for one round of “simple” revisions – things that are easily changed. Beyond that, revisions require a change order that includes an estimate for time.
